Die Beschäftigungsduldung
The regulations governing "Beschäftigungsduldung" permits for employment purposes contain clear criteria, according to which persons who can support themselves from their own resources and who are well integrated into German society are eligible. Temporary residence permits for employment purposes only apply to persons who entered Germany before August 1, 2022. This means that not everyone is eligible to receive one.
The employment permit is granted for a period of up to 30 months to both spouses and minor children living with their parents. This permit gives individuals legal certainty, as they cannot be deported during its period of validity.
The employment tolerance allows individuals to obtain a "Beschäftigungsduldung" in Germany after the 30 months have expired. If the individual continues to be employed after this period has expired, they may be granted a work permit in accordance with Section 25b (6) of the Foreigners Act. Sections 18a and 19d of the Residence Act may also be considered.
